Judge halts deportation temporarily
A federal judge has blocked the deportation of Wilber Rafael Garces Perez, a 28-year-old Venezuelan, after he was shot by ICE agents in Texas. A hearing is scheduled for September 30th.
“For now, we have secured a temporary block on his deportation while his case moves forward.”
DoorDash driver shot in the back

Garces Perez was making a delivery when an unmarked ICE truck sideswiped his car. When he made a U-turn, agents shot him, leaving a bullet lodged in his back and fracturing his clavicle.
Lawyer demands proper medical care
His attorney Kate Lincoln-Goldfinch says he's being held in detention with the bullet still in his back, experiencing significant swelling and pain. He was briefly hospitalized but returned to detention in an isolated room.
“Wilber still needs appropriate medical care, and we will continue fighting to protect his rights.”
ICE agent had no body camera
The ICE officer who shot Garces Perez joined the agency last year and was not wearing a body camera during the incident. Austin Police released dashcam footage showing the aftermath but not the shooting itself.
DHS defends its actions

The Department of Homeland Security says Garces Perez is an illegal alien with an expired work permit and was subject to a lawful vehicle stop. DHS Secretary Markwayne Mullin claims he received excellent medical care.
“No amount of smears and false narratives will slow down ICE from doing its job.”
Detention conditions questioned
Lincoln-Goldfinch alleges Garces Perez was handcuffed, shackled, and handled roughly despite his injury. She says detention staff revoked his communication privileges and moved him to an isolated room with a non-adjustable bed.
Lawmakers and protesters demand answers
Texas Democrat Joaquin Castro called for Garces Perez's release from detention. Dozens of protesters gathered at the scene demanding ICE leave Austin, while local officials push for an independent investigation.
Part of broader ICE concerns

This shooting follows a fatal ICE incident in Houston months earlier. The case raises questions about ICE agent training, use of force protocols, and accountability when agents operate without body cameras.
