Clinic ordered to pay Rs 86,200
The Tamil Nadu consumer commission ordered the clinic to pay Rs 51,200 as refund, Rs 25,000 for mental agony, and Rs 10,000 in litigation costs.
Clinic failed to justify retaining full payment
The commission held the clinic failed to justify keeping money for an incomplete and unsatisfactorily performed package.
Woman claimed health issues from cryotherapy
She later told the commission she developed a cold, fever and running nose after sessions, attributing it to low temperatures used during cryotherapy.
Woman gained weight instead of losing
She claimed she gained weight instead of losing weight after attending some sessions and discontinued the package.
Clinic could not prove value of 4 sessions
The clinic could not demonstrate that four sessions justified retaining the full fee or any contractual basis for keeping payment despite incomplete service.
The big picture
A Tamil Nadu consumer commission ordered a wellness clinic to refund Rs 51,200, pay Rs 25,000 for mental agony, and Rs 10,000 in litigation costs after a woman attended only four of ten cryotherapy sessions.
