Why ICE won't be at your polling place

A voting expert explains why armed federal agents at the polls is a fear campaign, not a plan.

In brief

A voting expert explains why armed federal agents at the polls is a fear campaign, not a plan. The threat of troops at the polls is meant to scare you into staying home. The law, the courts, and the way Americans actually vote all make it a non-starter. Originally reported by Mother Jones.

A flat no from an expert

David Becker, founder of the nonpartisan Center for Election Innovation & Research, told reporters on Friday that armed federal agents at polling places simply will not happen.

“ICE and troops will not be at the polls, period.”

Nobody has ruled it out

Trump and DOJ chief Todd Blanche have dodged the question. DHS chief Markwayne Mullin said officers could go to polls over a "threat" or a warrant, while insisting there are no plans.

Denver already sued

Democratic officials have raised alarms and the City of Denver went to court to block any such deployment before Election Day.

The statute is blunt

18 U.S.C. 592 bars "armed men" at polling places. Becker says the moment one shows up, jurisdictions are ready to file and get it blocked in court.

“As soon as there is an armed individual at a polling place, there will be a court action.”

It would backfire on Republicans

47 states offer early in-person voting and three-fourths allow no-excuse mail voting. Trump's attacks on mail ballots pushed Democrats to vote early, leaving Election Day crowds disproportionately Republican.

“You might inadvertently, if you're a Republican president, suppress your own voters.”

The fear is the point

Becker thinks some in the administration would love voters to believe it might happen, which is why they keep dancing around it. The Joint Chiefs chairman has already said there will be no troops.

“It is not going to happen.”

In short

The threat of troops at the polls is meant to scare you into staying home. The law, the courts, and the way Americans actually vote all make it a non-starter.
