Clancy's lawyer now questions if she killed her children

After a mistrial, Lindsay Clancy's defense argues there is insufficient evidence she murdered her three children, reversing the trial strategy.

In brief

After a mistrial, Lindsay Clancy's defense argues there is insufficient evidence she murdered her three children, reversing the trial strategy. Lindsay Clancy's lawyer argued there is insufficient evidence she killed her three children at a hearing after her murder trial ended in a deadlocked jury split eleven to one…

Trial ends in deadlock

Defendant Lindsay Clancy looks at the jury after Judge William Sullivan declared a mistrial in Clancy's murder trial on Friday, Sept. 4, 2026, in Plymouth, Mass

Lindsay Clancy's murder trial ended September fourth with a deadlocked jury split eleven to one in her favor. Her lawyer now argues there is insufficient evidence she killed her three children.

Defense strategy shifts

During the trial, attorney Kevin Reddington did not dispute that Clancy killed the children at the family's home in twenty twenty-three. Instead, he argued she was not criminally responsible due to postpartum psychosis, a rare mental condition.

Lawyer questions the evidence

At Tuesday's hearing, Reddington told Judge William Sullivan there is not enough evidence that Clancy killed the children. He pointed to her badly injured condition when found and her lack of memory of events when she woke in hospital.

“This entire case is based on speculation.”

Prosecution disputes the claim

Prosecution disputes the claim

Prosecutor Shanan Buckingham called the defense argument laughable. Prosecutors say Clancy used exercise bands to strangle five-year-old Cora, three-year-old Dawson and eight-month-old Callan, and knew her actions were wrong.

Jury holdout refuses to budge

Clancy's attorneys asked the judge to dismiss the case, arguing the one juror who favored conviction should have been removed after refusing to listen to the law on reasonable doubt. Juror Michael Desronvil said he had no doubts about his stance.

Prosecutors weigh next steps

Plymouth County District Attorney Timothy Cruz said prosecutors have yet to decide whether to retry Clancy on first-degree murder charges, seek lesser charges including second-degree murder or manslaughter, or drop the case entirely.

“We are going to do what we can for the children. That is what this case is about.”

Judge William Sullivan did not immediately decide the case and no trial date was set. Clancy remains charged with murder and is expected to stay at a psychiatric hospital until her case is resolved.
