Trump rescinds trans protections, but law stands

The administration's move to reinstate a 2020 rule is cruel but does not change Title IX's core protections for LGBTQ students.

In brief

The administration's move to reinstate a 2020 rule is cruel but does not change Title IX's core protections for LGBTQ students. Trump's administration rescinded Biden-era Title IX protections for LGBTQ students, but the underlying law still prohibits sex discrimination and protects transgender youth from exclusion…

Trump targets trans youth across government

Since taking office, President Donald Trump has targeted transgender people in education, employment, military service, identification and health care, using them as political pawns to mobilize his base.

Administration rescinds Biden Title IX protections

This week the Trump administration announced it is rescinding Biden-era regulations that protected LGBTQ students from discrimination. The move reinstates a two thousand twenty rule issued under Education Secretary Betsy DeVos.

Title IX itself still prohibits sex discrimination

The rescission is cruel but does not change the law. Title IX, the landmark nineteen seventy-two law prohibiting sex discrimination in schools, remains in force. The Supreme Court has held that discrimination against transgender people is sex discrimination.

Sports is the only exception the Court allowed

Earlier this year the Supreme Court permitted states and schools to exclude transgender women and girls from women's and girls' sports. Outside sports, federal and local protections for LGBTQ students remain valid and fully enforceable.

LGBTQ students face rising harassment in schools

A survey of two thousand eight hundred LGBTQ-identified students found sixty-eight percent experienced harassment or assault based on transgender status. After the two thousand twenty-four election, a follow-up focus group documented significant increases in hostility, bullying and harassment.

Schools must protect vulnerable students

With the administration's continued cruel anti-trans rhetoric, schools must not waver in their commitment to protecting LGBTQ students. State and local officials are now charged with defending this vulnerable group of young people.

The key point

Trump's administration rescinded Biden-era Title IX protections for LGBTQ students, but the underlying law still prohibits sex discrimination and protects transgender youth from exclusion outside sports.
