Oracle invokes force majeure
Oracle has sent a force majeure notice to the developer of Project Jupiter, a Stargate data center campus in New Mexico, according to Bloomberg.
What force majeure allows
Force majeure clauses excuse a party from contractual obligations when events outside its control get in the way. Oracle is not seeking to exit as the campus's main tenant.
Oracle's stated position

Oracle told CNBC that Project Jupiter remains on schedule and the company is fully committed to New Mexico and confident in its path forward.
“Project Jupiter remains on our planned schedule. We are fully committed to New Mexico and confident in our path forward.”
Energy supply delays mount
The campus is designed to handle two point four five gigawatts and run on gas-powered fuel cells from Bloom Energy. An Energy Transfer pipeline delivering gas has been delayed nearly six months to February first, twenty twenty-seven.
Regulatory hurdles continue
The pipeline's route was changed after regulators repeatedly denied permits. A separate air-quality permit for the fuel cell system is pending, with the state's environment department facing a November twenty-third deadline to decide.
Project faces political opposition

Project Jupiter is a flagship site of Stargate, announced by Oracle, OpenAI, and SoftBank with President Donald Trump. The campus has drawn opposition from residents and environmental groups and become a political flashpoint ahead of midterm elections.
What it means
Oracle has invoked force majeure on its New Mexico Stargate data center to delay payments if construction misses its 2028 target, citing energy supply setbacks beyond its control.
