Mail-In Voting Survives

The Supreme Court blocks Trump's last-minute attempt to restrict voting by mail before the midterms.

In brief

The Supreme Court blocks Trump's last-minute attempt to restrict voting by mail before the midterms. The Supreme Court rejected the Trump Administration's attempt to impose new mail-in voting restrictions just weeks before the midterm elections. Originally reported by The New Yorker.

Supreme Court blocks voting restrictions

The Court rejected the Trump Administration's bid to impose new mail-in voting rules. Only Alito and Thomas dissented.

Too late to change the rules

Kavanaugh said it was too late for officials to implement new requirements with midterms less than fifty days away.

Mail voting is now the norm

Nearly one in three voters now casts their ballot by mail. Some states have virtually eliminated in-person voting.

“Democrats are virtually Unelectable without using this completely disproven Mail-In SCAM.”

The regulation would cause chaos

States would have had to create bar-coded envelopes and upload voter lists to a non-operational federal portal.

Millions could lose their vote

Two dozen states warned that compliance would be impossible, meaning millions of voters would be unable to vote by mail.

“In some states, compliance would be impossible ahead of the midterms, meaning that millions of voters would be unable to vote by mail.”

Questionable legal authority

Questionable legal authority

The Constitution gives election authority to states and Congress, not the executive branch. The Postal Service claim was a stretch.

No evidence of fraud

The district judge found no evidence of fraudulent mail-in voting. Even if fraud existed, the rule wouldn't stop it.

“The record continues to lack any evidence regarding fraudulent absentee or mail-in voting.”

Alito blames the states

Alito said states were responsible for the delay, even though they immediately challenged the order after it was issued.

“The plaintiff States cannot claim the timing of the rule tilts the equities in their favor when they are responsible for so much of the delay.”

The Court has red lines

Some Trump measures go too far even for this conservative Court. Eliminating birthright citizenship and emergency tariffs crossed the line.

Trump denounces his own justices

Trump called the ruling destructive and said the three justices he appointed are merely a shell of their original selves.

“This Court will go down as having rendered some of the most destructive, hurtful, and damaging decisions in our Country's history.”

What it means

The Supreme Court rejected the Trump Administration's attempt to impose new mail-in voting restrictions just weeks before the midterm elections.
